TERMS AND CONDITIONS

This Terms of Use Agreement (the "Agreement") sets forth the terms and conditions which apply to your use of the DatingPsyche.com website and all services offered by DatingPsyche.com. By completing the subscription process you are indicating that you agree to be bound by all of the terms in this Agreement. Please print and keep a copy of this Agreement for your records.

We reserve the right, at any time, to change or modify the terms and conditions applicable to your subscription. ELIGIBILITY

You must be at least eighteen (18) years of age and single or separated from your spouse to register as a member of DatingPsyche or use the Website. Membership in the Service is void where prohibited. By using the Website, you represent and warrant that you have the right, authority and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement.

CODE OF CONDUCT

The following is a list of the kind of conduct that is illegal and/or prohibited on DatingPsyche. DatingPsyche reserves the right to take the appropriate legal actions at its sole discretion if the terms are violated.

  • You will keep all information provided to you through the Service as private and confidential and will not give such information to anyone without the permission of the person who provided it to you.
  • You will not use the Service to engage in any form of harassment or offensive behavior, including but not limited to the posting of communications, pictures or recordings which contain libelous, slanderous, abusive or defamatory statements, or racist, pornographic, obscene, or offensive language.

  • You will not post or transmit in any manner any contact information including, but not limited to, email addresses, "instant messenger" nicknames, telephone numbers, postal addresses, URLs, or full names through your publicly posted information.
  • You will not cause the Service to be accessed through an automated or robotic means, including but not limited to the rapid access of the site as in a denial-of-service attack. Such restriction shall not apply to legitimate search engine activity which does not place an unreasonable burden on the Service.
  • You will not provide material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under the age of 18.
  • You will not provide instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;

YOUR INTERACTIONS WITH OTHER MEMBERS

You are solely responsible for your interactions with other Members. You understand that DatingPsyche.com does not in any way screen its Members, nor does datingpsyche.com inquire into the backgrounds of its Members or attempt to verify the statements of its Members. datingpsyche.com makes no representations or warranties as to the conduct of Members or their compatibility with any current or future Members. In no event shall datingpsyche.com be liable for any damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of the Service, including without limitation, bodily injury, emotional distress, and/or any other damages resulting from communications or meetings with other registered users of this Service or persons you meet through this Service. You agree to take reasonable precautions in all interactions with other Members of the Service, particularly if you decide to meet offline or in person. You understand that datingpsyche.com makes no guarantees, either express or implied, regarding your ultimate compatibility with individuals you meet through the Service. You should not provide your financial information (for example, your credit card or bank account information) to other Members.

MONITORING OF INFORMATION

We reserve the right to monitor all advertisements, public postings and messages to ensure that they conform to content guidelines that are monitored by us and subject to change from time to time.

While we do not and cannot review every message or other material posted or sent by users of the Service, and are not responsible for any content of these messages or materials, we reserve the right, but are not obligated, to delete, move, or edit messages or materials, including without limitation profiles, public postings and messages, that we, in our sole discretion, deem to violate the Code of Conduct set out above or any other applicable content guidelines, or to be otherwise unacceptable. You shall remain solely responsible for the content of profiles, public postings, messages and other materials you may upload to the Service or users of the Service.

TERMINATION OF ACCESS TO SERVICE

We may, in our sole discretion, terminate or suspend your access to all or part of the Service at any time, with or without notice, for any reason, including, without limitation, breach of this Agreement. Without limiting the generality of the foregoing, any fraudulent, abusive, or otherwise illegal activity, or that may otherwise affect the enjoyment of the Service or the Internet by others may be grounds for termination of your access to all or part of the Service at our sole discretion, and you may be referred to appropriate law enforcement agencies. In order to protect the integrity of the Service, DatingPsyche.com reserves the right at any time in its sole discretion to block Members from certain IP addresses from accessing the Website.

MEMBER DISPUTES

You are solely responsible for your interactions with other DatingPsyche.com Members. DatingPsyche.com reserves the right, but has no obligation, to monitor disputes between you and other Members.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

datingpsyche.com is not responsible for the conduct, whether online or offline, of any user of the website or member of the service. datingpsyche.com assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user or member communications. datingpsyche.com.com is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the internet or at any website or combination thereof, including injury or damage to users and/or members or to any other person's computer related to or resulting from participating or downloading materials in connection with the web and/or in connection with the service. JURISDICTION AND CHOICE OF LAW

If there is any dispute arising out of the Website and/or the Service, by using the Website, you expressly agree that any such dispute shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions, and you expressly agree and consent to the exclusive jurisdiction and venue of the state and federal courts of the State of Florida, in Miami-Dade County, for the resolution of any such dispute.

INDEMNITY

You hereby agree to indemnify, defend and hold harmless DatingPsyche and all officers, directors, owners, agents, information providers, affiliates, licensors and licensees (collectively, the "Indemnified Parties") from and against any and all liability and costs, including, without limitation, reasonable attorneys' fees, incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of this Agreement or the foregoing representations, warranties and covenants. You shall cooperate as fully as reasonably required in the defense of any such claim. DatingPsyche reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.

NO THIRD PARTY BENEFICIARIES

You agree that, except as otherwise expressly provided in this Agreement, there shall be no third party beneficiaries to this Agreement.

OTHER

This Agreement contains the entire agreement between you and DatingPsyche.com regarding the use of the Website and/or the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.

FEE FOR SERVICES

In addition to the free services provided on the DatingPsyche.com Web site, certain services are offered which require payment for service. Where payment is required, the following additional terms and conditions will apply.

PRIVACY OF FINANCIAL INFORMATION

DatingPsyche will use the credit card information you provide to bill you for goods and services. By registering for a for-fee service and providing your credit card details, you agree to be billed by us for your for-fee service in advance. DatingPsyche will not share your financial information with third-parties, except as necessary to process your payment. By providing your credit card details to us, you consent to and authorize us to provide your credit card details to such credit card processors and financial institutions as are necessary to process your payment.

TERMINATION OF SERVICES FOR NON-PAYMENT

Where payment is required for a service and we are unable to charge your credit card for any reason, we may discontinue any and all service to you either temporarily or permanently.

CANCELLATION OF SERVICES

You may request cancellation of services of any DatingPsyche service at any time. Where, however, a fee has been paid for a service, all such payments for service is non-refundable. Where billing for a service is recurring on a monthly, yearly or other periodic basis, the unused portion of the current service period will not be refunded.

DISCLOSURE AND OTHER COMMUNICATION

We reserve the right to send electronic mail to you, for the purpose of informing you of changes or additions to the Service or of any DatingPsyche related products and services. We reserve the right to disclose information about your usage of the Service and demographics in forms that do not reveal your personal identity.
